Band director convicted of sex with student


Carlie Rose Attebury, 31-year-old former music teacher at El Modena High School, Orange County, California, is on trial facing multiple sex charges for her alleged sexual relationship with a teen boy.

According to her attorney, Attebury had sex with former students and other men over age 18 during “sexual kick-backs” at her home, but will deny on the witness stand that she had sex with an underage boy she taught in the marching band. She faces two felony counts of unlawful sexual intercourse, one felony count of lewd acts on a child, two felony counts of oral copulation of a minor under 16, one felony count of sexual penetration by foreign object of a minor, and one felony count of dissuading a witness from reporting a crime.

In 2009, a former student who was in an alumni band pleaded guilty to felony extortion for threatening to reveal Attebury’s relationship with the boy and demanding money and pornographic photos. Miguel Lopez was sentenced to three years’ probation in that case. His allegations led to Attebury’s arrest.

Attebury had sex with 15-year-old band studentduring his sophomore year at El Modena High School in Orange, where she was his band teacher, Deputy District Attorney alleged in her opening statement. The boy testified he first met Attebury at his second day at school as a freshman in 2006 when he joined the band program. The alleged victim, now an 18-year-old student at Santa Ana College, testified that he developed a crush on his teacher in his sophomore year. In November 2007, he confessed his feelings for Attebury and they “French-kissed” for a minute or so. The relationship between the two grew from there.
