Denise Harvey now a fugitive in Vero Beach underage sex case


Denise Harvey, 43, formerly of Vero Beach, got out of the Indian River County Jail in 2008 under a $150,000 bail soon after she appealed her sentence and conviction of repeatedly having sex with her son's 16-year-old friend on a Vero Beach High School baseball team in 2006.

Investigators went to Harvey's last known address in Deltona, Fla., and found that she hasn't been living there and "hadn't been for months," Assistant State Attorney Nikki Robinson said Monday.

On March 1, a warrant was issued for her arrest. "We do not know where she is." Robinson said.

If she doesn't turn herself in, she could face an additional charge punishable by up to five years in state prison.

"She's on the run," Robinson said. Her bail bond company, Barnett Bail Bond, refused comment.

On March 3, the Supreme Court turned down a legal case on which Harvey's appeal to the Supreme Court was based. Her attorney had hoped to get a new trial based on a judge disallowing testimony that Harvey's victim might have previously falsely claimed that he had sex with another married woman.

The Supreme Court ruled that such false testimony can't be allowed.
