Gail Gagne sentenced

Gail Gagne, 28-year-old female teacher formerly at Cretin-Derham Hall High School received a stayed jail sentence of one year and a $300 fine for having sex three years ago with a teen boy. Under the plea agreement she also must register as a sex offender in both Minnesota and California, where she now lives and will be on probation for two years and was ordered to have no contact with the student or his family.

Under the agreement, one count of third-degree criminal sexual conduct, a felony, was dropped and a second count was reduced from a third- to fifth-degree felony, making it a gross misdemeanor.

According to the victim, he was completing a work-study job in the athletic weight room at Cretin-Derham Hall in summer 2008. He was a student athlete and also used the weight room. He “became acquainted” with Gagne because she was the weight room supervisor, the complaint said.

Gagne took the student out for meals that summer and gave him rides home from the school. He reported “that on several occasions,” Gail Gagne “engaged in sexual conduct with him,” the complaint said. At the time, Gagne lived in Bloomington and she brought the student to her home “and engaged in oral sexual penetration with him,” the student told police, according to the complaint said.

Later, the student said Gagne took him to a hotel near the Mall of America. They spent the night and had sex, the student said. Hotel records and credit card receipts do confirm Gagne staying at a La Quinta hotel in Bloomington, Minnesota, near the Mall of America on the nights of September 13-14, 2008.

Cretin-Derham Hall hired Gagne as assistant basketball coach in November 2007, the school’s principal told police. She was a substitute teacher on a daily basis from January to September 2008. In summer 2008, Gagne was the weight room supervisor. The school hired her as a full-time teacher in September 2008.

“As the weight room supervisor, her duties included working with students to ensure that they safely and properly used the equipment and supervising the work study students who worked in the weight room,” the complaint said. “He (the principal) added that she most certainly was in a position of authority over the work study students.”
