According to prosecutors, between January 2009 and November 2010 Cortez had sex with two male students, ages 16 and 17, in her home in Montebello. The first boy stepped forward a because he wanted to get the incidents "off his chest." That student's confession resulted in the discovery of a second victim, and at the time detectives believed there still might have been be more out there, but no additional victims were found during the investigation.

The former teacher faced a maximum sentence of six years and four months behind bars, but the judge ordered just a probation with no jail time. The judge said he was persuaded by Cortez's attorney, Edward Robinson, that probation would be "the just sentence."
